• Arrested on drug charge

Kevin Dillingham, 50, of Everly, was arrested at his home on Aug. 8 on a warrant for failing to appear. According to the Clay County Sheriff’s Office, a baggie of containing methamphetamine was discovered as Dillingham was being taken into custody.

Dillingham was charged with Possession of a Controlled Substance-3rd or subsequent offense, a class D felony. Bond was set at $600 on the warrants and $5,000 cash or surety on the drug charge.

• Found passed out in vehicle

David Charles Nachtigal, 31, of Melvin, was arrested by the O’Brien County Sheriff’s Office after an incident near Sanborn.

The sheriff’s office received a report that a Ford Escape had driven into a farm driveway and parked. Attempts to make contact with Nachtigal were unsuccessful as he was passed out behind the wheel. Nachtigal was still passed out when a deputy arrived, with the vehicle still running and his foot on the brake pedal. Nachtigal appeared to be intoxicated, but would not submit to field sobriety testing or a preliminary breath test.

A search warrant was obtained and a sample of Nachtigal’s blood was taken, which will be tested by the Department of Criminal Investigation crime lab. He was charged with Operating While Intoxicated-3rd or Subsequent Offense, a class D felony. The arrest log also lists that Nachtigal was charged with Driving While Barred, Driving While Denied or Revoked and Interference with Official Acts.

Nachtigal waived his initial appearance and preliminary hearing. He was held in the county jail at Primghar.
