• Accused of passing fake checks

The Sheldon Police Department has filed a complaint with the O’Brien County Clerk of Court regarding the alleged presenting of checks that they knew were known not to be legitimate at Peoples Bank in Sheldon.

The complaint alleges that Jesse Eldridge, 18, of Sanborn, and Daniel Molenaar, 26, of Hull, presented checks that appeared to be drawn on a bank in Pennsylvania with the intent to exchange them for cash. The checks had the correct routing number and a name and address of a current account holder at that bank, but the account number was inaccurate and the signature was a fake.

Both men were charged with Forgery, a class D felony. A preliminary hearing was held on May 19. Eldridge and Molenaar were released from jail after posting $5,000 bond.

• Charged with OWI after accident

The Clay County Sheriff’s Office received a report of a single vehicle rollover at the intersection of Highway 10 and 492nd Street west of Peterson on May 14.

Upon investigation, it was determined that Amber Wetherell, 36, of Peterson, had lost control of a 2012 Jeep Grand Cherokee and drove into the ditch. As Wetherell attempted to exit the ditch, the vehicle tipped and rolled onto its roof. Deputies later determined that Wetherell was under the influence of alcohol.

Wetherell was charged with OWI-1st, a serious misdemeanor. She was held in the county jail awaiting an initial appearance before a judge.

• Traffic stops lead to arrests

During a stop for a traffic violation on May 19 in the 4100 mile of Highway 71, a Clay County deputy observed an alcoholic beverage container inside the vehicle. The rear passenger, Nicholas Hurd, was allegedly in possession of alcohol and tobacco under the legal age of 21. He was cited and released for Minor in Possession-Alcohol and Minor in Possession of Tobacco, both simple misdemeanors.

Another passenger, Breydon Kosky, 18, of Storm Lake, was allegedly in possession of marijuana and drug paraphernalia. He was charged with Possession of a Controlled Substance-Marijuana, a serious misdemeanor, and Possession of Drug Paraphernalia, a simple misdemeanor. He was held in jail to appear before the magistrate.

Upon investigation during a traffic stop in the 4700 mile of Highway 71 on May 21, it was found that Lao Xiong, 70, of Storm Lake, did not have a valid driver’s license. It is also alleged that vehicle’s owner, Phoua Her, knowingly allowed Xiong to drive without a license.

Xiong was charged with Driving Under Suspension, No Driver’s License, No Insurance and Speeding, all simple misdemeanors. He was held in jail to appear before a magistrate. Her was cited for Permitting an Unauthorized Person to Drive, a simple misdemeanor, and released.

A deputy initiated a traffic stop on May 20 in the 5000 mile of Highway 71. The driver, Damian Morton, 32, of Rembrandt, was suspected of being under the influence of alcohol. Field sobriety tests were given and Morton was charged with OWI-2nd, an aggravated misdemeanor, as well as Operation without Registration, No Insurance and No Driver’s License, simple misdemeanors. He was held to appear before the magistrate.

• No injuries in accident

The Clay County Sheriff’s Office investigated an accident that occurred at the junction of Highways 18 and 71 in Spencer, at 7:50 a.m. on May 19.

The report stated that shortly after turning south from Highway 18, a vehicle in front of a 2018 Ford Fusion driven by Kathy Wolthuizen, 56, of Sanborn, slowed abruptly. Wolthuizen swerved her vehicle into the other lane, colliding with a 2016 Buick Enclave driven by a juvenile female, 15, of Spencer.

No injuries were reported. Damage to the Fusion was $2,000 and damage to the Enclave owned by Neil Scharnberg was estimated at $1,500. The report indicated that charges are pending.

• Garage damaged by vehicle

A garage located at a rural Sanborn residence was damaged in an accident that occurred at 11:29 a.m. on May 17.

The O’Brien County Sheriff’s Office reported that Elizabeth Ann Smith, 56, of Alton, stopped in the driveway to deliver a package. Smith thought the vehicle was in Park but as she exited, it shifted gear and began moving forward. She got back into the vehicle and accidently hit the gas pedal. The 2016 Jeep Wrangler struck the garage wall of the house, pushing in the wall and garage door approximately three feet.

Smith was not injured. Damage to the structure owned by Christopher Wolters, of Sanborn, was listed at $20,000. The Jeep sustained $3,000 in damage.
