• Sentenced for possession of child porn

Johnny E. Gutierrez, 21, of Melvin, was sentenced to four years in federal prison after pleading guilty to two counts of possession of child pornography.

According to the United States Attorney’s Office, Gutierrez was sentenced on Feb. 24 in Sioux City by United Stated District Court Chief Judge Leonard T. Strand. His sentence includes 48 months’ imprisonment and a payment of $3,000 in restitution. Gutierrez must also serve a five-year term of supervised release after the prison term. There is no parole in the federal system.

In his guilty plea on April 21, 2021, Gutierrez admitted that between February 2016 and November 2019 he had possessed visual depictions of minors engaged in sexually explicit conduct, including depictions involving a minor who had not attained 12 years of age. The release also stated that Gutierrez admitted to distributing child pornography to other individuals.

As a result of the investigation, officers recovered approximately 51 images and 26 videos of child pornography from Gutierrez’s computer hard drive and approximately 38 other images from his cell phone.

The case was brought as part of Project Safe Childhood, a nationwide initiative launched by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. The case was prosecuted by the United States Attorney’s Office for the Northern District of Iowa and investigated by Homeland Security Investigation.
